As a customer and user, it is especially important that you read, understand and agree to the following terms and conditions:

General Information

All materials comply with Joyful Features' material standards and are reviewed by Joyful Features before they are licensed. Photos, text files, data files and other digital media content available on the website are collectively referred to as "materials". 'We' and 'us' means Joyful Features m, 'You' or the 'Customer' or 'User' means you or, if you are acting on behalf of your employer, then 'you' means that employer. 'This website' and 'the website' means www.joyfulfeatures.com

Privacy Statement

Joyful Features respects your privacy, protects your personal data and does not share information with third parties without your consent.

Our site stores information about which pages and content are viewed for the purpose of optimizing and improving this website.

Any information added to our database about our users will only be used for the purposes stated on this website, i.e. to notify users of updates, news and marketing purposes if the user has requested this. Our site uses cookies to keep track of membership and to make the use of this site easier, for example by automatically entering information when users are required to fill in forms. Contact Sheets and Low-Res Images

Registered users may download contact forms, pdf and request low-resolution images, such as those appearing on the site, for test layouts, internal presentations etc. These low-resolution images may not be used commercially without prior permission from Joyful Features. Low-resolution images may not be distributed or published, including distribution or publication in electronic or online systems.

Rights of Reproduction

All materials may only be used in an "editorial" manner, i.e. in newspaper or magazine articles. The materials may not be used in any commercial or promotional manner, unless agreed with Joyful Features.
All licenses are for one-time use only, i.e. a reproduction for one edition of a single publication, published in one language only. Furthermore, the duration of all licenses is limited to 6 months from the date of publication of the material.
You must acknowledge that the materials are the valuable property of Joyful Features. No ownership or copyright in those materials will pass to the customer. Joyful Features only grants the right to reproduce the materials. All photos on this website are the property of the photographers Joyce Vloet / Joyful Features and are protected by international property and copyright laws. Images, text and articles appearing on this website cannot be reproduced in any media, website, blog or social network, unless you have purchased a feature for editorial publication purposes.
You may not use any materials for purposes other than the agreed purpose without first obtaining permission from Joyful Features, and with respect to which additional costs will be agreed. Reproduction rights are personal to you and cannot be assigned by you to a third party. Any republication, any new appearance or publication, any transfer to another medium or to another title, to a database or to third parties is prohibited without prior written permission from Joyful Features.
You may translate and edit text files with respect for the original text. All facts must be correctly reproduced and included in the edited text. If you have any questions or doubts about the content of the text, you must contact Joyful Features before reproducing the material.
6a. You may only reproduce 2 - 4 images online, up to a maximum of 400 x 300 pixels per image. The online publication is limited to 6 months from the date of publication in the magazine.
You must mention the name of the photographer Joyce Vloet / Joyful Features and stylist in the credit line.
6b. Online publication of the 2-4 images is permitted only in the context of the feature and is promote the sale of that particular single edition.
The material will be faithfully reproduced and, unless Joyful Features gives its express written permission in advance, may not be manipulated, colored, solarized or otherwise altered in any way.
Full credit and copyright information must accompany the material. You must ensure that a credit is clearly printed next to or near each reproduction of an image, or (in the case of a magazine or book) that this credit is printed on the colophon/title/attribution page with a clear reference to the location of the relevant image or images. The credit for editorial features and individual images must be in the following format: Joyful Features www.joyfulfeatures.nl

You will provide Joyful Features free of charge with two proof copies of the publication in which any material has been reproduced.
Joyful Features will also appreciate a PDF of the publication by email.

Invoice and Payment Terms

The cost of the materials is agreed with Joyful Features.
All prices are exclusive of VAT.
Joyful Features applies the following payment terms.
Payment terms: 10 days from the date of invoice, unless otherwise agreed. Joyful Features invoices are paid by the Customer 10 days after the invoice date in the agreed currency by bank transfer. If bank transfer is not possible, another payment method can be accepted by individual agreement with Joyful Features.
In case of late payment of Joyful Features invoices by the Customer, Joyful Features is entitled to charge a penalty/late payment interest of 1.5% (one and a half percent) of the outstanding invoiced amount per month of late payment. Joyful Features is also entitled to immediately terminate the right to reproduce the granted use if the invoice(s) of Joyful Features remain unpaid on the 15th of the month after a period of 90 days from the invoice date, unless otherwise agreed with Joyful Features.
For further use of received material other than the material agreed between Joyful Features and the Customer, the Customer is obliged to inform, obtain permission and agree a conditional compensation prior to use. Additional use may be coverage use, additional pages or use in other media than agreed. If Joyful Features is not informed of additional use of material, we have the right to claim compensation as determined by Joyful Features.

Warranties

Once the Customer has agreed to the use for assignment, the Customer warrants Joyful Features against any non-compliant use of the assigned material and against any claim by third parties for non-compliant use of any assigned material.

Joyful Features cannot be held liable for any wording (text, title, caption, etc.) that accompanies the material. Likewise, Joyful Features cannot be held liable for the Customer's use of materials or for any complaints or lawsuits by third parties relating to the Customer's use of materials.

Entire Agreement

This contract contains all the terms of the agreement between Joyful Features and the Customer regarding delivery and review of the material and no terms or conditions may be added or deleted unless in writing and signed by both Joyful Features and the Customer.
